Khoản 17 Điều 4 Luật Công nghệ thông tin năm 2006 quy định: Trang thông tin điện tử (Website) là trang thông tin hoặc một tập hợp trang thông tin trên môi trường mạng phục vụ cho việc cung cấp, trao đổi thông tin. Website được bảo hộ quyền tác giả dưới hai hình thức sau:
Thứ nhất, tác phẩm mỹ thuật ứng dụng. Tác phẩm mỹ thuật ứng dụng là tác phẩm được thể hiện bởi đường nét, màu sắc, hình khối, bố cục với tính năng hữu ích, có thể gắn liền với một đồ vật hữu ích, được sản xuất thủ công hoặc công nghiệp như: Thiết kế đồ họa (hình thức thể hiện của biểu trưng, hệ thống nhận diện và bao bì sản phẩm), thiết kế thời trang, tạo dáng sản phẩm, thiết kế nội thất, trang trí (khoản 2 Điều 13 Nghị định 22/2018/NĐ-CP). Website sẽ đăng ký bảo hộ giao diện của mình dưới hình thức tác phẩm mỹ thuật ứng dụng.
Thứ hai, chương trình máy tính. Chương trình máy tính là tập hợp các chỉ dẫn được thể hiện dưới dạng các lệnh, các mã, lược đồ hoặc bất kỳ dạng nào khác, khi gắn vào một phương tiện mà máy tính đọc được, có khả năng làm cho máy tính thực hiện được một công việc hoặc đạt được một kết quả cụ thể (khoản 1 Điều 22 Luật Sở hữu trí tuệ năm 2005 sửa đổi bổ sung năm 2009, 2019). Website sẽ đăng ký bảo hộ code dưới hình thức chương trình máy tính.
II. Đơn đăng ký bản quyền website
1. Đơn đăng ký website dưới hình thức tác phẩm mỹ thuật ứng dụng
+ Đơn đăng ký bản quyền giao diện website.
+ Cam đoan của tác giả viết giao diện do mình sáng tạo ra và không sao chép của bất kỳ ai.
+ Tuyên bố của tác giả về chủ sở hữu tác phẩm (áp dụng trong trường hợp tác giả kiêm chủ sở hữu).
+ Quyết định của công ty giao việc cho tác giả sáng tạo ra giao diện website (trong trường hợp công ty là chủ sở hữu website); hoặc hợp đồng thuê bên khác sáng tạo (thiết kế) ra giao diện website.
+ 02 bản in giao diện website trên Giấy A4.
+ Bản sao chứng minh thư nhân dân/thẻ căn cước/hộ chiếu của tác giả.
+ Bản sao chứng minh thư của chủ sở hữu (cá nhân) hoặc giấy chứng nhận đăng ký kinh doanh công ty (pháp nhân).
2. Đơn đăng ký website dưới hình thức chương trình máy tính
+ Đơn đăng ký bản quyền chương trình máy tính.
+ 02 đĩa CD chứa code của website.
+ 02 bản in code website kèm theo giao diện trang chủ.
+ Cam đoan của tác giả về việc tự viết code website, không sao chép của bất kỳ cá nhân/tổ chức nào.
+ Quyết định giao việc cho nhân viên ra code website (trong trường hợp tác giả là nhân viên công ty) hoặc hợp đồng thuê bên ngoài thiết kế (trường hợp thuê bên thứ 3 tiến hành).
+ 01 bản sao chứng minh thư nhân dân của tác giả.
+ 01 bản sao chứng minh thư nhân dân của của chủ sở hữu website (cá nhân) hoặc giấy chứng nhận đăng ký kinh doanh chủ sở hữu website (pháp nhân).
III. Thủ tục đăng ký bản quyền website
Để thực hiện đăng ký bản quyền website, tổ chức, cá nhân cần tiến hành theo các bước sau:
Bước 1. Nộp đơn đăng ký quyền tác giả
Tác giả, chủ sở hữu quyền tác giả trực tiếp hoặc ủy quyền cho tổ chức, cá nhân khác nộp 01 bộ hồ sơ đăng ký quyền tác giả tại Bộ Văn hóa, Thể thao và Du lịch (Cục Bản quyền tác giả hoặc Văn phòng đại diện của Cục Bản quyền tác giả tại thành phố Hồ Chí Minh, thành phố Đà Nẵng). Hồ sơ có thể gửi qua đường bưu điện.
Bước 2. Xử lý đơn đăng ký
Trong thời hạn mười lăm ngày làm việc, kể từ ngày nhận đơn hợp lệ, cơ quan quản lý nhà nước về quyền tác giả có trách nhiệm cấp Giấy chứng nhận đăng ký quyền tác giả cho người nộp đơn.
Trong trường hợp từ chối cấp Giấy chứng nhận đăng ký quyền tác giả thì cơ quan quản lý nhà nước về quyền tác giả phải thông báo bằng văn bản cho người nộp đơn.
IV. Phí đăng ký
Điều 40 Nghị định 22/2018/NĐ-CP quy định tổ chức, cá nhân có nghĩa vụ nộp phí khi tiến hành thủ tục đăng ký quyền tác giả, quyền liên quan theo quy định của pháp luật. Thông tư 211/2016/TT-BTC quy định cụ thể về mức phí phải nộp khi thực hiện thủ tục đăng ký quyền tác giả. Theo đó phí sẽ được Cục Bản quyền tác giả thu khi tổ chức, cá nhân nộp hồ sơ đề nghị cấp giấy chứng nhận đăng ký quyền tác tác. Cụ thể phí này sẽ phụ thuộc vào đối tượng được bảo hộ quyền tác giả (Điều 4 Thông tư 211/2016/TT-BTC):
– Đăng ký quyền tác giả tác phẩm mỹ thuật ứng dụng: 400.000 đồng.
– Đăng ký quyền tác giả chương trình máy tính: 600.000 đồng.
